Congress now has Evidence that Israel possesses Nuclear Weapons- which by Law should End US Arms Sales to Israel.
According to the Times of Israel, the leak of classified documents regarding Israel’s military capabilities first appeared on Telegram around October 17, 2024, then again appeared on Twitter on October 17, 2024. The Times of Israel published the leaked documents in full on October 20- documents which are published here again using screenshots from the Times of Israel article.
Times of Israel: US House speaker confirms probe into intelligence leak on Israel’s Iran attack plans, October 20, 2024:
The leaked document originated from the National Geospatial Agency and clearly showed that the United States was monitoring whether or not Israel intended to use nuclear weapons against Iran.
The sale of weapons to Israel is illegal for a number of reasons, including the existence of Israel’s nuclear weapons.
In January 2009, Congressman Dennis Kucinich provided evidence to Condoleezza Rice that Israel had violated the requirements of the Arms Export Control Act of 1976.
In light of press reports that Israeli forces fired on a United Nations school where civilians were taking shelter, Congressman Dennis Kucinich (D-OH) today sent notice to Secretary of State, Dr. Condoleezza Rice, that Israel’s actions in Gaza since December 27th, 2008 may constitute a violation of the requirements of the Arms Export Control Act of 1976 (AECA).
When the President is aware of the possibility of such violations, the AECA requires a report to Congress on the potential violation(s). The AECA outlines the conditions under which countries may use military articles or services obtained from the U.S. government, which include “internal security” or “legitimate self defense.”
The letter offers preliminary evidence that there may be a violation of the requirements of AECA. For example, Israeli forces have used F-16 fighter jets and Apache helicopters to precede and to support ongoing ground actions such as the one today in which 40 Palestinians were killed while taking shelter in a U.N. facility.
Recently the fact that Israel had blocked humanitarian aid from the United States to Palestine should also have triggered an end to sales of Arms to Israel. On May 10, 2024, Anthony Blinkin perjured himself to Congress while denying that Israel had interfered with US humanitarian aid.
Propublica: Israel Deliberately Blocked Humanitarian Aid to Gaza, Two Government Bodies Concluded. Antony Blinken Rejected Them, September 24, 2024.
The U.S. Agency for International Development delivered its assessment to Secretary of State Antony Blinken and the State Department’s refugees bureau made its stance known to top diplomats in late April. Their conclusion was explosive because U.S. law requires the government to cut off weapons shipments to countries that prevent the delivery of U.S.-backed humanitarian aid. Israel has been largely dependent on American bombs and other weapons in Gaza since Hamas’ Oct. 7 attacks.
But Blinken and the administration of President Joe Biden did not accept either finding. Days later, on May 10, Blinken delivered a carefully worded statement to Congress that said, “We do not currently assess that the Israeli government is prohibiting or otherwise restricting the transport or delivery of U.S. humanitarian assistance.”
Prior to his report, USAID had sent Blinken a detailed 17-page memo on Israel’s conduct. The memo described instances of Israeli interference with aid efforts, including killing aid workers, razing agricultural structures, bombing ambulances and hospitals, sitting on supply depots and routinely turning away trucks full of food and medicine.
The sale of US arms to Israel is also illegal because Israel is an undeclared nuclear power. The Times of Israel made a good summary of why in August 2016:
Times of Israel: Lawsuit claims US aid to Israel violates nuclear pact, August 12, 2016.
A lawsuit filed in a US district court claims that American aid to Israel is illegal under a law passed in the 1970s that prohibits aid to nuclear powers who don’t sign the Nuclear Non-Proliferation Treaty.
Grant Smith, director of the Institute for Research: Middle Eastern Policy, who filed the lawsuit Monday with a Washington DC court, said the United States has given Israel an estimated $234 billion in foreign aid since Congress in 1976 passed the International Security Assistance and Arms Export Control Act, with its stipulation regarding countries that did not sign the NPT, according to Courthouse News.
Discussing his August 8 lawsuit in an interview to Court House News, Smith said the litigation has been 10 years in the making.
Though Israel is not a signatory to the Nuclear Non-Proliferation Treaty, Smith noted that it is a known nuclear power and recipient of US aid. Israel has neither confirmed nor denied possession of nuclear weapons but is widely believed to possess dozens if not hundreds of nuclear warheads.
The US has had a long-standing policy of keeping mum on the existence of Israel’s nuclear weapons program, an open secret that successive US administrations since Gerald Ford have refused to publicly acknowledge.
It’s an open secret that Israel has nuclear weapons, but the US government takes great pains to never publicly acknowledge it, because they would not be able to sell arms to Israel otherwise.
As the Times of Israel reported, the US government threatens US employees with prosecutions and imprisonment for disclosing the existence of Israel’s nuclear weapons.
To sustain a policy of “nuclear ambiguity” on Israel’s weapons program, Smith says the government uses improper classification and threatens federal employees and researchers with prosecution, fines and imprisonment.
Of course it’s no surprise that the DOJ has chosen to prosecute CIA employee Rahman over this, but Rahman is not the only government employee who has broken the law. A document from a US government agency disclosing the existence of Israel’s nuclear weapons has now been released and published by the Times of Israel. Countless government employees have broken the law by intentionally concealing the fact that Israel possesses nuclear weapons in order to further Israel’s Genocide and their efforts to create a larger war in the Middle East backed by the United States. I think it’s only fair to prosecute them all. Congress is equally guilty of breaking US Law if they do not immediately end arms sales to Israel, now that they have unequivocal evidence from Rahman that the arms sales violate Laws related to arms sales of undeclared nuclear powers.
